DALLAS, TEXAS, August 16, 2023 – Human Coalition on Wednesday applauded the U.S. Fifth Circuit Court of Appeals for revoking the Food and Drug Administration’s (FDA) approval of mail-order abortion pills, in Alliance for Hippocratic Medicine v. U.S. Food and Drug Administration.
While abortion pills may remain on the U.S. market, a unanimous panel of the Fifth Circuit ruled on Wednesday that they may not be distributed through the mail. In addition, the judges upheld a lower court ruling that restored critical safety regulations the FDA recklessly tossed aside in recent years. These include a limit to use of the pills at seven weeks gestation, a requirement that the pills be prescribed in-person by a doctor, and mandatory reporting of non-fatal adverse effects of the pills.
Human Coalition supports national medical organizations and doctors in their legal challenge to the FDA’s expedited and illegal approval of the drug mifepristone for chemical abortions.
Chelsey Youman, National Director of Public Policy for Human Coalition, on Wednesday stated:
“This ruling is a critical win for protecting children in the womb and upholding women’s safety. The Biden administration recklessly expanded the abortion pill regimen by allowing these deadly drugs to be shipped through the mail, and we commend these judges for applying scrutiny to this expansion while activists in the government abdicated their responsibilities to protect patients.
“Our brief in this case detailed the confusion and betrayal experienced by our clients who were misled about the effects of abortion pills. These women came to our clinics scared and confused, unprepared for the trauma and physical ailments they suffered from chemical abortions. We must listen to their voices, and stand up for the voiceless children in the womb whose lives are snuffed out every day by chemical abortions.
“Congratulations to these brave doctors and Alliance Defending Freedom for boldly standing up for life against the abortion pill. While these deadly pills are still on the market, we at Human Coalition will continue the work of rescuing children from abortion and serving vulnerable women. We continue to hope for an end to these barbaric chemical abortions.”
Human Coalition’s amicus brief at the Fifth Circuit detailed the trauma and confusion of clients who felt misled and uninformed about mifepristone and its side effects. Judge Kacsmaryk relied heavily on Human Coalition’s brief in his April 7 ruling against the FDA’s approval of the abortion pill regimen.
